What is CBD?

CBD, or cannabidiol, is a cannabinoid naturally found in the hemp plant. When oil is extracted from the hemp plant, it contains CBD, THC and other cannabinoids, as well as various substances like fatty acids, vitamins and flavonoids. The oil is then processed and used to make CBD gummies (like ZenBears) and other CBD products.

Over the last few years, CBD has been blowing up on the UK media thanks to the tens of 1000’s of reported anecdotal health claims. However, ZenBears and other over-the-counter CBD products are not allowed to promote any medicinal benefits of CBD, even those backed by scientific research studies. This is due to ZenBears being sold as a food supplement & not a registered medicine.

What we are allowed to say is that CBD interacts with the human body by working with the endocannabinoid system (ECS) that consists of a series of CB1 and CB2 receptors through the entire human body. This system is responsible for keeping the body in a state of homeostasis (balance) and is involved in a variety of functions including pain, memory, mood, appetite, stress, sleep, metabolism, immune function.

What is the legal status of CBD in the UK?

CBD is legal to sell and consume in the UK, provided that it meets certain conditions:

CBD products must be made from specific strains of EU-approved hemp containing no more than 0.2% THC.

The final CBD product must not contain more than 1mg of THC per container. Some brands have been tested and found to contain more THC than advertised, sometimes at illegal levels.

To avoid any unintentional run-ins with the law, we recommend that you only sell CBD products that have been independently tested by a third party lab to verify THC content.

Do I need a license to sell CBD in the UK?

No, you don’t need a licence to sell CBD. However, you must make sure that the products you’re selling meet the legal requirements for THC content and are marketed correctly.

What do I need to know about marketing CBD in the UK?

CBD marketing in the UK is regulated by the Medicines and Healthcare Products Regulatory Agency (MHRA). The MHRA does not recognise CBD as a medicine, so you’re not allowed to make any medical or therapeutic claims. That means you can’t say things like:

“CBD oil will get rid of your back pain.”
“CBD gummies can cure anxiety.”

You can say things like:

“CBD is becoming very popular as a wellbeing supplement.”
“There are lots of anecdotal reports about CBD helping with chronic pain, but this is still being studied.”

Can you sell CBD on Google?

Google currently doesn’t allow businesses to advertise CBD through their Google Ads platform. Some marketers might give you “loopholes” and workarounds, but Google is usually quick to catch up and you may find your site blacklisted. We say don’t risk it!

Can you sell CBD on Facebook?

Like Google, Facebook doesn’t allow ads promoting CBD.

Are there any other CBD rules and regulations I should know about?

The Food Standards Agency (FSA) considers CBD products to be “novel foods” and requires the original manufacturers to obtain authorisation for their products. As a reseller, you must only sell products that have been authorised, and you must make sure that you market them for use only in the way they were authorised to be used.

The FSA recently announced that all CBD products must be assessed for novel food authorisation in order to continue to be sold legally in UK. The deadline for applications is currently 31st March 2021, after which unauthorised products will be removed from the market.

If you intend to re-sell CBD products, ensure that your supplier has received novel foods authorisation, or that they have a plan in place to do so, so that your business is not interrupted.
